Media Policy
To repeal the Broadcasting Act, 1976 (Act No. 73 of 1976), so as to establish a new broadcasting policy for the Republic; to amend certain provisions of the Independent Broadcasting Authority Act, 1993 (Act No. 153 of 1993); to clarify the powers of the Minister in regard to policy formulation and the Authority's powers with respect to the regulation and licensing of the broadcasting system; to provide for classes of broadcasting activities in the public interest and for that purpose--
to provide a Charter for the South African Broadcasting Corporation Ltd;
to establish the Frequency Spectrum Directorate in the Department;
to establish the South African Broadcasting Production Advisory Body; and
to establish a human resource capacity in policy development;
and to provide for matters connected therewith...
ICASA CODE OF CONDUCT FOR BROADCASTERS
FOREWORD
1. Section 2 of the Independent Broadcasting Authority Act No. 153 of 1993 ("the Act") enjoins the Independent Broadcasting Authority ("the Authority") to ensure that broadcasting licensees adhere to a Code of Conduct acceptable to the Authority.
2. In terms of section 56(1) of the Act, "all broadcasting licensees shall adhere to the Code of Conduct for Broadcasting Services as set out in Schedule 1." The provisions of that sub- section do not, however, apply to any broadcasting licensee "if he or she is a member of a body which has proved to the satisfaction of the Authority that its members subscribe and adhere to a Code of Conduct enforced by that body by means of its own disciplinary mechanism, and provided that such Code of Conduct and disciplinary mechanisms are acceptable to the Authority".
